Inteligencia Artificial vs. Identidad personal y humana: Algunas Reflexiones ético-jurídicas

Resumen


El trabajo tiene como objetivo exponer el origen, naturaleza, definición, funcionamiento y etapas
de desarrollo de la Inteligencia artificial (IA), resaltando los retos y desafíos que la misma significa,
hasta reflexionar en torno al impacto que en la identidad y dignidad humana esta tecnología
posee. Para ello, se sigue una metodología teórica descriptiva-explicativa que permite analizar la
relación entre la ciencia cognitiva con la IA, describiendo la dialéctica que significa el fenómeno
de la tecnologización de la mente y la humanización de la máquina, diferenciando la inteligencia
natural de la artificial, explicando el proceso de automatización así como el papel fundamental
que juega la plasticidad del cerebro en el desarrollo de la IA, haciendo la advertencia del peligro
de llegar así a la automaticidad vaciada de toda autonomía. La investigación tiene una base doctrinaria:
McCarthy (2007), Expertos en IA de la Comisión Europea (2021), Kaplan y Haenlein
(2019), Cáceres Nieto (2010), Abarca (2021), Smink (2023), Iglesias (2021) Gudin (2020),
Porcelli (2021), De Asís (2022), Llano, (2022), entre otros. Finalmente, se concluye que la IA
involucra transformaciones radicales para la humanidad, entre otras, surgimiento de nuevos derechos,
previo a exponer algunas reflexiones ético-jurídicas.
